    Terms of Service

    These Terms govern your access to and use of Second Look Cancer, including our websites, applications, trial discovery tools, educational content, and related features.

    Important Medical Disclaimer

    Second Look is an informational and educational clinical trial discovery tool. It is not a medical device and does not provide medical advice, diagnosis, treatment, cure, prevention, monitoring, disease-management instructions, urgent-care support, or eligibility determinations. Always consult qualified healthcare professionals and trial sites before making medical or enrollment decisions.

    1. Acceptance of Terms

    By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

    We may update these Terms from time to time. If we make material changes, we will provide notice through the Service and/or by email where appropriate. Continued use after changes become effective constitutes acceptance.

    2. Eligibility and Accounts

    You must be legally able to enter into a binding agreement in your jurisdiction to use the Service. If you create an account, you agree to provide accurate information, keep your credentials secure, and notify us promptly of unauthorized access.

    You are responsible for activity under your account and for keeping your profile information current enough for the Service to organize trial information usefully.

    3. Service Description

    What Second Look Provides

    • • Clinical trial search, filtering, relevance ranking, saved-trial, and site-contact preparation tools.
    • • Patient-friendly summaries, educational content, source context, maps, and logistics-oriented trial information.
    • • Optional trial tracker, patient experience review, and de-identified insight features.

    What Second Look Does Not Provide

    • • Medical advice, diagnosis, treatment recommendations, or clinical decision-making.
    • • Trial eligibility, suitability, enrollment, site availability, or acceptance determinations.
    • • Emergency, urgent-care, crisis, insurance, billing, financial, legal, or regulatory advice.
    • • A physician-patient, clinician-patient, research-site, sponsor, navigator, or fiduciary relationship.

    Trial information can change quickly. You must verify details directly with the trial sponsor, study site, official registry record, and your oncology team before acting.

    4. User Responsibilities

    You agree to:

    • • use the Service only for lawful, personal, informational, and educational purposes;
    • • provide information you have the right to provide and avoid submitting information about others without permission;
    • • independently verify trial information before contacting a site, changing care plans, or pursuing enrollment;
    • • consult qualified healthcare professionals before making medical decisions;
    • • not interfere with, misuse, or disrupt the Service.

    5. Acceptable Use and Prohibited Conduct

    You agree not to, and not to permit any third party to:

    5.1 Automated Access, Scraping, and Harvesting

    • • access, search, collect, export, or copy Service content through automated means, including bots, crawlers, scrapers, or AI agents, except as explicitly authorized by us in writing;
    • • perform bulk downloading, harvesting, systematic copying, or dataset extraction from any part of the Service;
    • • bypass robots.txt, rate limits, authentication, paywalls, or other access controls.

    5.2 Competitive Use and Product Development

    • • use the Service, content, or outputs to develop, train, benchmark, validate, improve, or market a competing product or substantially similar substitute without our prior written consent;
    • • systematically analyze the Service to replicate features, workflows, prompts, schemas, ranking logic, summaries, interfaces, or proprietary design elements.

    5.3 Reverse Engineering and Security

    • • reverse engineer, decompile, disassemble, or attempt to derive source code, underlying ideas, algorithms, models, prompts, data structures, or non-public datasets, except where restrictions are prohibited by applicable law;
    • • probe, scan, test, or exploit Service vulnerabilities or systems connected to the Service;
    • • introduce malware, attempt credential stuffing, or create abusive traffic patterns.

    5.4 Misuse and Misrepresentation

    • • impersonate a person or entity or misrepresent affiliation with a trial site, sponsor, healthcare organization, or Second Look;
    • • submit unlawful, misleading, abusive, infringing, or privacy-invasive content;
    • • use the Service in a way that could expose another person's health information without authorization.

    We may investigate violations and may suspend or terminate access immediately if we reasonably believe you violated this section or pose risk to the Service, users, or our rights.

    6. Intellectual Property and Data Sources

    6.1 Our Content and Technology

    The Service, including software, design, text, graphics, logos, interfaces, workflows, ranking approaches, and underlying technology, is owned by Second Look or its licensors and protected by intellectual property laws.

    6.2 Trial Data and Third-Party Content

    Trial listings and source records may come from ClinicalTrials.gov, sponsors, sites, publications, conference materials, or other public and third-party sources. Those sources may be subject to their own rights, disclaimers, and use terms.

    6.3 Outputs and Enhancements

    Second Look may generate or display summaries, classifications, labels, relevance signals, logistics context, and other enriched materials. These outputs are provided for informational purposes and may be incomplete, outdated, or incorrect.

    6.4 License to You

    Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial clinical trial research and educational purposes.

    7. User Content and Review Permissions

    If you submit information to the Service, you represent that you have the right to provide it. User Content includes health profile data, notes, saved-trial activity, trial tracker responses, reviews, ratings, feedback, and support messages.

    You grant Second Look a limited license to host, store, process, display, analyze, and use User Content to provide, secure, support, and improve the Service, consistent with our Privacy Policy.

    7.1 Trial Experience Reviews

    By submitting a trial experience review, rating, or feedback, you additionally allow Second Look to de-identify your submission and use it in patient-facing, research, nonprofit, partner, analytics, or commercial insight contexts. Specifically:

    • • You represent that your review is based on your genuine personal experience or information you are authorized to submit;
    • • You understand that we may remove names, contact information, and other identifying details before sharing a review;
    • • We may edit, decline, or remove reviews that contain identifying information, unrelated material, prohibited content, or information that creates safety or privacy risk;
    • • If you delete your account, personal account data tied to your reviews will be removed while de-identified or aggregated insights may remain as described in our Privacy Policy.

    8. Privacy and Data Protection

    Our Privacy Policy explains how we collect, use, disclose, protect, and retain information. By using the Service, you acknowledge those practices.

    • • We do not sell personally identifiable health information.
    • • We may share or license de-identified or aggregated patient experience data and insights as described in our Privacy Policy.
    • • You may update or delete your account information from Settings, subject to limited legal, security, backup, and de-identified retention practices.

    9. Availability, Changes, and Termination

    We may modify, suspend, discontinue, or restrict parts of the Service at any time, including features, content, data sources, and availability by geography or platform.

    We may suspend or terminate your account or access for violations of these Terms, to protect the Service or users, to comply with law, or for other legitimate operational reasons. Upon termination, the license granted to you ends immediately.

    10. Disclaimers

    10.1 No Medical Advice or Medical Device Claim

    The Service is not medical advice, is not a substitute for professional care, and is not intended to diagnose, treat, cure, prevent, monitor, or manage any disease or condition.

    10.2 Accuracy, Timeliness, and Source Limits

    We do not warrant that trial information, outputs, summaries, source material, contact details, statuses, locations, or relevance results are complete, accurate, current, or suitable for your circumstances. Trials and registry records can change rapidly.

    10.3 "As Is" and No Warranties

    To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

    11. Limitation of Liability

    To the maximum extent permitted by law, Second Look and its directors, officers, employees, contractors, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, health outcomes, enrollment opportunities, or other intangible losses arising from or related to your use of or inability to use the Service.

    To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amounts you paid to us for the Service in the 12 months before the event giving rise to the claim or CAD $100.

    Some jurisdictions limit exclusions or liability caps; in those jurisdictions, these limits apply to the maximum extent permitted.

    12. Indemnification

    You agree to defend, indemnify, and hold harmless Second Look from and against claims, damages, liabilities, losses, and expenses, including reasonable legal fees, arising from:

    • • your use or misuse of the Service;
    • • your User Content;
    • • your violation of these Terms;
    • • your infringement or violation of another person's rights.

    13. Enforcement and Injunctive Relief

    You acknowledge that violations of Sections 5 or 6, including scraping, competitive misuse, security probing, or reverse engineering, may cause irreparable harm for which monetary damages may be inadequate. We may seek injunctive relief, equitable remedies, and any other remedies available at law, including recovery of legal fees where permitted.

    14. Governing Law and Venue

    These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of laws principles.

    Subject to mandatory consumer protection laws, you agree that any dispute will be brought in the courts located in Ontario, Canada, and you consent to their jurisdiction.
